What is Fine Print?

Fine print refers to text in a formal agreement that is printed in a smaller font than the rest of the document, often containing contract terms, conditions, and disclosures. Often referred to as small print or mouse print, these are agreements that users are asked to accept before using an app or online service. They often contain obscure details that dictate your legal rights, financial obligations, and what happens if things go wrong.

Examples of information commonly found in fine print include:

  • Limitations and Exclusions: Specific conditions under which a guarantee is voided, or items that are not eligible for a discount or promotion.

  • Fees and Penalties: Hidden costs, recurring subscription charges, cancellation fees, or late-payment penalties.

  • Deadlines: Exact expiration dates for offers, validity periods for coupons, or time limits for returning purchases.

  • Liability Clauses: Terms that limit a company's financial or legal responsibility for accidents, damages, or service interruptions.

  • Cancellation Policies: The rules, notice requirements, and procedures needed to terminate a contract.

  • Arbitration and Dispute Terms: Rules that dictate how conflicts must be resolved.

Why Companies Use Fine Print

Companies use fine print to legally protect themselves, outline specific terms and conditions, and clarify details of an offer. However, fine print is often criticized for containing hidden fees, restrictions, and deadlines.

Through terms and conditions, companies can limit their liability if a service fails, a user loses data, or technical issues occur. Furthermore, companies may include dispute resolution clauses that prevent individuals from pursuing certain legal actions when conflicts arise.

Consent or Compliance?

Although users technically give consent by clicking the "I Agree" button, can this truly be considered informed consent?

One of the essential elements in contract formation is the intention to create legal relations. However, most people do not read the lengthy terms and conditions presented to them, and even those who try may struggle to understand the complex legal language involved.

This creates an imbalance between companies, which have teams of lawyers drafting these agreements, and ordinary users, who are expected to understand them within minutes.

An example of the potentially serious consequences of fine print can be seen in the case of Jeffrey Piccolo v. Walt Disney Parks and Resorts and Raglan Road Irish Pub. Jeffrey Piccolo filed a wrongful death lawsuit following the fatal allergic reaction suffered by his wife, Dr. Kanokporn Tangsuan. Disney's lawyers initially argued that his Disney+ subscription agreement required disputes to be resolved through arbitration. Although Disney later withdrew this claim following significant public backlash, the case demonstrated the potentially far-reaching consequences of agreements that many users accept without fully understanding.

Precautions People Can Take

Before clicking "Accept," users should take a few moments to review important sections relating to data collection, information sharing, and privacy policies.

It is also advisable to regularly check app permissions and disable access to features such as location services, contacts, microphones, or cameras when they are not necessary.

Choosing apps and services that are transparent about how they collect and use data can further reduce privacy risks. By paying closer attention to how personal information is handled and adjusting privacy settings when needed, users can make more informed decisions about the digital services they use every day.
